General provisions

  1. [Terms and Conditions] These Terms and Conditions (hereinafter: „Terms and Conditions”) set forth the terms and conditions for the use of the website available at: https://mv-center.com/ (hereinafter: „Site”) and the terms and conditions for the electronic provision of services through the Site (hereinafter: “Services“).
  2. [Familiarization] Each person shall, before using the Site, familiarize themselves with the Terms and Conditions.
  3. [Act] To the extent that the Regulations refer to services provided by means of an information and communication system that provides for the processing and storage, as well as the sending and receiving of data via telecommunications networks in accordance with the Act of July 18, 2002 on the provision of electronic services, the Regulations are the regulations referred to in Article 8 of the Act.
  4. [Owner] The owner and administrator of the Site is MV Center Systemy Wizyjne Sp z o.o. with its registered office in Balice at: Krakowska 50 Street, 32-083 Balice, entered the Register of Entrepreneurs of the National Court Register, kept by the District Court for Krakow-Śródmieście in Krakow, XII Economic Department of the National Court Register, under KRS number 0000737796, with NIP number 5130255480, e-mail address for contact: biuro@mv-center.pl, tel. : +48-12-397-50-05 or +48-12-397-50-06, open from Monday to Friday, excluding public holidays, from 9:00 a.m. to 5:00 p.m. (hereinafter:Owner”).
  5. [User] A User of the Site is any natural person who uses the Site, including persons acting on behalf of entities that are not natural persons.
  6. [Privacy Policy] The principles, purposes and grounds for the processing of personal data collected in connection with the use of the Site and the Services provided thereunder, as well as the rights of data subjects and other information regarding the processing of personal data are set forth in the Privacy Policy available at URL: https://mv center.com/en/rodo (hereinafter: „Privacy Policy”).
  7. [Prohibited Activities] The User shall use the Site in accordance with its intended purpose. It is forbidden, within the framework of using the Site, for the User to undertake activities that could interfere with the proper functioning of the Site, as well as to provide unlawful content within the Site. Unlawful content is, in particular, content that violates the law, including intellectual property rights, good morals or personal rights of the Owner and third parties.
  8. [Technical requirements] Use of the Site requires:
    • a personal computer or mobile device such as a tablet or smartphone;
    • a properly configured and up-to-date web browser;
    • access to the Internet. Connecting to the Internet may incur costs from your Internet provider. These are costs unrelated to the use of the Services and are not charged by the Owner;
  1. [Possible risks] The use of the Site and the Services is not associated with risks to the security of the User’s information and communication system other than the usual risks, associated with the use of the Internet, which include, but are not limited to computer viruses, malicious software, attacks by third parties aimed at breaking the security of the system of the User’s or the Party’s ICT for illegal acquisition of information, including personal data.
  2. [Prevention] In order to prevent threats, including those referred to in the preceding paragraph, Users are advised to use software that protects against these threats, in the form of antivirus and similar programs. The Owner shall apply adequate security measures aimed at ensuring the security of data, including personal data transmitted through the Site and their protection from unlawful access, in particular by encrypting data transmitted through the Site.
  3. [Maintenance] The Owner does not guarantee the continuous and uninterrupted availability of the Site, in particular, the Owner does not exclude the possibility of temporarily suspending or limiting the availability of the Site, including for the time necessary for maintenance, review, or in connection with the need to upgrade or expand the Site. The Owner will post an announcement on the Site well in advance about planned interruptions in the availability of the Site.

Services

  1. [Provision of Services] Through the Site, the Owner shall provide Services including:
    • the ability to review information publicly available on the Site,
      in particular concerning the Owner’s business;
    • enabling the Owner to be contacted by sending messages to the Owner through the Site.
  2. [Access to Content] Upon entering the Site, the Owner shall provide the User electronically with a Service consisting of enabling access to and familiarization with the content and resources made available on the Site. This Service is provided free of charge, at a place and time chosen by the User, and does not require registration on the Site. The agreement for electronic provision of the Service referred to in this paragraph between the Owner and the User is terminated when the User leaves the Site.
  3. [Content on the Site] The content and resources made available on the Site by the Owner, including text, images and other materials belong entirely to the Owner, unless expressly stated otherwise, and include, but are not limited to:
    • contact information regarding the Owner;
    • information on projects completed by the Owner;
    • information about the Owner’s services and offerings.

Contact form

  1. [Form] The contact form service allows you to submit a message to the Owner using an interactive tool within the Site.
  2. [Elements] Using the contact service requires you to indicate your name, email address and telephone number for contact, as well as enter the content of your message.
  3. Familiarizing yourself with the Terms and Conditions] Before sending a message to the Owner, you must familiarize yourself with these Terms and Conditions and the Privacy Policy.
  4. [Correct address] When entering your e-mail address and telephone number, you should verify their correctness, as using them the Owner will respond to you in connection with the contact undertaken.
  5. [Sending] In order to send an inquiry, after confirming that you have read the Terms and Conditions and Privacy Policy, select the “Send Inquiry” or similar button.
  6. [Marketing Consents] Before submitting the form, the User may check the appropriate box and consent to the Owner’s marketing communications being directed to the indicated e-mail address and telephone number. By giving such consent, the User assures that he/she is the user of the indicated e-mail address and telephone number, or that he/she has been authorized by their user to send the specified content of the inquiry and give marketing consent.
  7. [Voluntariness] The granting of marketing consent is in any case voluntary. Directing an inquiry to the Owner regarding its services, offerings or activities will result in information regarding such matters being provided in response to the inquiry.

Complaints

  1. [How to report] Complaints regarding the operation of the Site and the Services provided through it may be submitted in writing to the address of MV Center Systemy Wizyjne sp. z o.o., ul. Krakowska 50, 32-083 Balice or to the contact e-mail address:: biuro@mv-center.pl.
  2. [Contents of the complaint] In the complaint, indicate your name and surname and the correspondence or e-mail address to which a response to the complaint should be addressed, the reason for filing the complaint and the request, if any.
  3. [Response] The Owner shall consider complaints on the basis of the Terms and Conditions and laws generally applicable in Poland and shall respond to the complaint within 14 (fourteen) days from the date of receipt. The response to the complaint shall be provided in accordance with the indications of the person filing the complaint pursuant to paragraph 2 above, or if there are no such indications, in a manner analogous to the manner of filing the complaint.
  4. [Voluntariness] The complaint procedure is entirely voluntary.

Final provisions

  1. [Polish law] These Terms and Conditions shall be governed by the laws generally applicable in Poland.
  2. [PDF] The Terms and Conditions are made available on the Site in PDF format in a manner that allows for downloading and saving.
  3. [Amendments to the Terms and Conditions] The Owner reserves the right to amend the Terms and Conditions. The Terms and Conditions may be amended for a valid reason. By valid reason is understood, in particular:
    • the need to update contact information, including names or links provided in the Regulations;
    • the need to adapt the Regulations to changing legal regulations concerning the issues regulated by the Regulations;
    • the need to comply with rulings or decisions or recommendations of authorized courts or state administration bodies on issues concerning the content regulated by the Regulations;
    • change in the operation of the Site, including its expansion and addition of new functionalities;
    • change of technical conditions for providing the Services;
    • the need to remove possible errors or ambiguities, should they appear in the Regulations;
    • the need to modify the Terms and Conditions to avoid abuse or violations of the Terms and Conditions.
  4. [Information about the change] The Owner shall inform at least 14 days in advance of a change to the Terms and Conditions in the form of an announcement informing the User of the changes made on the Site. The amended Terms and Conditions shall bind the User as of the effective date.
